- WP Engine is a leading web host in the managed WordPress host category used by many business owners.
- Log Data is information your browser sends us whenever you visit our website. Log Data may include information such as your computer’s browser type, the browser version, the pages of our site that you visit, the time and date of your visit, the time spent on those pages, and other statistics.
We do not make any attempt to use these third-party technologies to find out the identities of those visiting our website unless this information is directly provided to us by the visitor. It is your responsibility to adjust your browser settings to accommodate your personal privacy preferences and, by your use of our website without configuring your browser to opt-out from Google Analytics or any other third-party technologies, you have consented to our collection of information as discussed above.

How will we use your personal data?
We may offer the option to receive information and updates from KAI via SMS or MMS text messages. This section explains our text messaging practices and your rights with respect to text communications. Because text messaging involves use of your telephone, we take care to comply with the Telephone Consumer Protection Act (TCPA) and other applicable U.S. laws and industry guidelines.
Opt-In Consent
We will only send you marketing or non-emergency text messages if you have opted in to receive them. For example, we may ask you to sign up via an online form or to text a keyword to a designated number to enroll. By providing your mobile phone number and affirmatively opting in, you consent to receive recurring automated text messages from KAI (which may be sent via an automatic telephone dialing system) at the number you provide. Message frequency may vary. Your consent to receive texts is voluntary and not a condition of purchasing any goods or services from KAI.
Types of Text Messages
With your consent, KAI may send text messages for purposes such as:
- Project & Service Updates – Notifications or correspondence related to your projects, appointments, or services you have with us (e.g. meeting reminders or status updates on a design or build project).
- Marketing & Promotions – Occasional announcements about new services, company news, events, or promotions that might interest you. These will be sent only if you have agreed to receive marketing communications.
- Alerts and Notifications – Important alerts regarding your account or transactions (for example, critical updates, security notifications, or changes to this Privacy Policy or our Terms).
We will specify in the opt-in request the kinds of messages you are agreeing to receive and an estimate of frequency. In general, for promotional or newsletter-type programs you can expect to receive no more than a handful of messages per month (for example, up to 4 messages per month), and for project-specific or transactional communications, messages will be sent on an as-needed basis.
How to Opt Out: You may opt out of receiving text messages from KAI at any time.
To revoke your consent and stop future texts, you can use any of the following methods: reply with the word “STOP” (or keywords like STOP, END, CANCEL, UNSUBSCRIBE, or QUIT) to any KAI text message you receive, or contact us directly to request removal. For example, you may email us with the subject “Unsubscribe SMS,” or call our main line (see Contact Us below) to let us know. After you send a STOP message, we will send a one-time confirmation text to acknowledge your opt-out, and thereafter you should no longer receive marketing/promotional texts. (Please note that if you are a current client, we may still send non-marketing or service-related texts necessary for ongoing projects or transactions, as permitted by law.)

Message and Data Rates
KAI does not charge you to enroll in or receive text messages; however, standard message and data rates may apply. Your mobile carrier may charge you for texts sent to or from us, depending on your plan. You are responsible for any mobile carrier charges you incur. Charges for text messaging services will appear on your mobile phone bill or be deducted from your prepaid balance.
Carrier Information
Our text messaging program is compatible with most major wireless carriers in the United States, including AT&T, Verizon, T-Mobile, Sprint, and others. Note that carriers are not liable for delayed or undelivered messages. Text message delivery may be affected by factors outside of KAI’s control, such as network issues or service outages, and we cannot guarantee that messages will be delivered or that they will arrive within a specific time frame.
Information Collected via Text
If you opt into KAI’s text messaging program, we will collect and maintain records related to your consent and interactions. This includes your mobile number, the date/time and method of your opt-in consent, and logs of the messages we send and receive (e.g. delivery confirmations, read receipts, and opt-out requests). We do not share your phone number or text message details with third parties for their own marketing. Your information is used solely for managing our communications with you and will be shared only with service providers who help us send texts (and who are contractually bound to protect your data). We retain proof of your consent and opt-out requests for at least four years or as required by law.
Compliance
KAI’s texting practices are intended to comply with applicable U.S. laws and industry guidelines, including the Telephone Consumer Protection Act (TCPA) and the Cellular Telecommunications Industry Association (CTIA) rules. We also follow relevant state laws regarding text communications and marketing. We register any required texting campaigns with the appropriate registries (such as The Campaign Registry) as required by major carriers. We value your rights and preferences, and we will not send you text communications without the appropriate consent.
How do we share your personal data?
There are circumstances where we may wish to disclose or are compelled to disclose your personal information to third parties. This will only take place in accordance with the applicable law, for the purposes listed above.
Business Affiliates
We may share your personal information with one of our subsidiaries, branches, and associated offices. We include the subsidiaries listed at the beginning of this policy. Any of our subsidiaries, branches, or associated offices who receive this information from us are not authorized to use or share the information, except as set out in this privacy policy.
Service Providers
We may share your personal information with vendors or service providers who provide services to us, such as providing data processing and other information technology services, carrying out research and analysis, marketing and advertising services, personalizing individual user and customer experiences, among others.
- Outsourced vendors or subconsultants to facilitate the provision of our services (including other professional service providers)
- Third-party service providers and consultants to protect the security or integrity of our business, including our databases and systems and for business continuity reasons (including cloud service providers)
- Attorneys in connection with negotiation of a contract, dispute resolution, and other legal advice
- Tax Advisors for purposes of tax filings, obtaining tax credits, negotiating tax liabilities, and other tax advice
Business Transfers
We may, for strategic or other business reasons, decide to sell or transfer all or part of our business. As part of such sale or transfer, we may choose or be required to pass personal information we have collected and stored to anyone involved in the sale or transfer. We may also elect to engage in a joint venture for portions of our business where we elect to share assets between the joint venture.
We may, for strategic or other business reasons, elect to collaborate with another legal entity, on a temporary or permanent basis, for the purposes of a joint venture, collaboration, financing, sale, merger, reorganization, change of legal form, dissolution, or similar event.
In any scenario, this might include all or any portion of our assets.
Non-Identifiable or Aggregate Information
We may, at times, share information that does not directly identify you. For example, we may share anonymous, aggregated statistics about your use of our online services. We may combine information about you with other consumers and share the information in a way that does not link to a specific customer.
Legal Entities
We have the right to use or share personal information as necessary to keep in compliance with any law, regulation, or legal request, to protect our online services and in-office technology, to bring or defend legal claims, to protect the rights, interests, safety and security of our organization, our employees, or members of the public, or in connection with investigating fraud or other crime, or violations of our policies.
We might send these items to:
- Public Authorities, which might include the police, financial crime investigative agency, or fraud detection agency, to investigate fraud or corruption, or to conduct any similar sharing permitted by applicable law.
- A government entity in response to a government request.
- Third Parties where we are required by law, such as to comply with a subpoena, or similar legal process in any country where we operate.
Transfer of Data
Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.
If you are located outside United States and choose to provide information to us, please note that we transfer the data, including Personal Data, to United States and process it there.
Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.
We will take all steps reasonably necessary to ensure that your data is treated securely and in accordance with this Privacy Policy and no transfer of your Personal Data will take place to an organization or a country unless there are adequate controls in place including the security of your data and other personal information.
How long do we keep your personal data?
We retain personal information only for as long as reasonably necessary to fulfill the purposes for which it was collected, as outlined in this Policy, and to comply with applicable legal or business requirements. This means that we will keep your information: (a) for as long as you maintain an account or relationship with us; (b) for as long as needed to provide you with services or support; and (c) for a reasonable period thereafter, or as otherwise required by law. For example, we may retain certain transaction details or communications to comply with professional record-keeping obligations or statutes of limitation.
When we determine that personal data is no longer needed, we will either delete it or anonymize it so that it can no longer be associated with an identifiable individual. In some cases, we may retain archived copies for backup, fraud prevention, or auditing purposes. We may also keep aggregated or de-identified information (which is not linked to any individual) indefinitely, to analyze our business performance and historical trends.
What are your rights?
You are responsible for maintaining the accuracy of the information you submit to us. We may allow you to access, review, correct, update, and remove or restrict access to personal information you have provided through your interaction or communication with us.
Your Data Protection Rights Under General Data Protection Regulation (GDPR)
In certain countries, individuals are entitled to the right to access, correct, transmit, restrict, delete, and object to procession of their personal information we have collected. In these certain countries, individuals are also entitled to withdraw consent to process personal information.
When we receive a request to exercise one of the above stated rights, we will respond within a reasonable time following receipt of a verified data subject request, in any event, within the time specified by law. We will also provide information on the action we intend to take on the request in accordance with applicable law. Persons exercising these rights must submit proof of identity and residency in the EU when the request is made.
Right to be informed – You have the right to obtain confirmation as to whether your personal information is being collected and processed.
Right to Access – If your personal information is being collected, you have the right to access the personal information collected from you. If you would like to access the personal information we have collected, please see the Contact Us section at the end of this policy.
Right to Rectification – You are responsible for maintaining the accuracy of the information you submit to us. You have the right to update and rectify any personal information that is incorrect by contacting us using the Contact Us section at the end of this policy.
Right to Erasure – You have the right to request the deletion of your personal information collected by us.
Right to Restrict Processing – You have the right to restrict the processing of your personal information. You may, as permitted by law, withdraw your consent to the processing of your personal information at any time by contacting us as directed in the Contact Us section. Such withdrawal will not affect the lawfulness of processing based on your previous consent. Please note that if you withdraw your consent, you may not be able to benefit from certain service features for which the processing of your personal information is essential.
Right to Data Portability – You have the right to receive, in a structured, digital format, personal data that concerns you and which you have provided to us. To request delivery of the data provided, please see the Contact Us section at the end of this policy.
Right to Object – You have the right, on grounds particular to you, to object to the processing of your personal information.

California Residents
The CCPA permits customers in California to request certain details about how their information is shared with third parties and, in some cases, affiliates for those third parties’ and affiliates’ own direct marketing purposes.
If you are a California resident, you may request information about our compliance with this law by contacting us with the information available in the Contact Us section. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address or mailing address.
If you are a California resident under 18 years old, you can request that we remove content or information that you have posted to our website or other online services. Note that fulfilment of the request may not ensure complete or comprehensive removal (e.g., if the content or information has been reposted by another user). To request removal of content or information, please see the Contact Us section with “Request for California Privacy Information” in the subject line.
Consumers exercising their rights will be required to complete a questionnaire and submit proof of identity and residency in California. Verification of identity will require, at a minimum, two (2) forms of government issued identification (such as a passport and driver’s license) and (1) form of proof of residency (such as a utility bill) showing residency in California at the time the request is made. We may request additional information we deem necessary or desirable to verify the identity of a person making a request under the CCPA for specific personal information. All information requested during the verification process shall be used solely for verification of identity and residency.
Consumers have the right to designate an agent to act on their behalf. Consumers wishing to do this and agents acting on behalf of Consumers should contact us as provided in the Contact Us section.
We do not sell personal information as defined under the CCPA.
Consumers have the right to:
- Request to Know. You have the right to obtain a copy of the personal information and the categories of personal information we hold about you by contacting us as directed above.
- Request to Delete. You have the right to request that we delete your personal information by contacting us as directed above.
- You have the right to receive our products and services on equal terms regardless of whether you exercise your rights under the CCPA.
“Shine the Light” Law: Separate from CCPA, California’s “Shine the Light” law (Civil Code § 1798.83) allows customers to ask for details about certain types of personal information a business shares with third parties for direct marketing purposes. As stated above, KAI does not share your personal information with unaffiliated third parties for their own direct marketing. If you have questions about this or believe this may have occurred, you may contact us for more information.
Minors’ Rights (California Users Under 18): If you are a California resident under the age of 18 and are a registered user of our online services, you may request the removal of any content or information you have publicly posted on our websites (subject to certain exceptions). To request removal of your own postings, please contact us as described below with a detailed description of the content. Note that removal does not ensure complete or comprehensive erasure of the content posted (for example, content that was reposted by others or that is required to be retained by law may not be fully removed), but we will make a good faith effort to remove or anonymize the content as required by California law.
Other U.S. State Privacy Rights: Privacy laws in certain other states (such as Colorado, Virginia, Connecticut, and Utah) provide residents with rights to access, delete, or correct personal information, and to opt out of certain data uses like targeted advertising or sales. International Data Transfers
KAI is based in the United States and primarily targets its services to U.S. individuals and businesses. If you are visiting our website or using our services from outside the U.S., please be aware that any information you provide will be transferred to and processed in the United States (or other jurisdictions where our service providers or affiliates may operate). These jurisdictions may not offer the same level of data protection as the laws in your home country. However, regardless of where your data is processed, we will handle it in line with this Privacy Policy. By using our website or providing us with information, you acknowledge and consent to the transfer of your personal data to the United States. Children’s personal data
Our services and websites are not intended for children under the age of 13, and we do not knowingly collect personal information online from children under 13 years old. If you are under 13, please do not provide any personal information to us. Parents or guardians should consult https://www.ftc.gov/ to learn more about protecting children’s privacy online. If we learn that we have inadvertently collected personal data from a child under 13, we will delete that information as soon as possible.
